The confidentiality of your personal data is one of the main concerns of SC Diane Marie Studio SRL, headquartered in Bucharest, 10 Lacul Plopului Street, as data controller.

Who are we?

SC Diane Marie Studio Srl, hereinafter referred to as Diane Marie, “we” is a company from Romania, with its registered office in Bucharest, 10 Lacul Plopului Street, sector 5, registered with the Trade Register under number J40/10442/2011, fiscal code RO29048600, email office@pantofidianemarie.ro

Dianemarie.ro is an online store. In order to be able to fulfill this purpose, we contact our visitors who wish, at their initiative, to place orders. We subsequently process the data in order to deliver the orders registered on the site. We also carry out marketing / promotion campaigns to attract buyers for various products and other personal data processing operations that we explain below.

The document below is therefore very important, because it explains why we need certain personal data in order to provide certain services.   • ID card, passport or identity card number;
  • location data (for example, the location data feature available on a mobile phone)

  • someone's silhouette from CCTV footage;
  • a car registration number;

The definition of personal data also contains several important elements:

  1. Personal data refers to information about individuals, not legal entities. The distinction is important because, for example, the registration number from the Trade Register, the Fiscal Code or other identification elements of some companies are not personal data.
  2. It does not matter whether the processing of these personal data is done through an automated system or through a non-automated system (e.g. manual processing), if it is part of a structured data recording system. The only important thing is that we are talking about a processing of this type of data.

The information we collect

Dianemarie.ro collects personal data in two important ways:

  1. Information provided directly by you, through dianemarie.ro forms (for example, as a result of registering as a member of the dianemarie.ro community, as a result of requesting a Dianemarie.ro service, as a result of orders placed on the site or as a result of subscribing to Dianemarie.ro newsletters).

We use this data to allow you access to the site and to deliver the products and services you have chosen to receive (the ordered product, newsletters, etc.). The legal basis for this processing is the entry and execution of a contract to which you are a party (whenever you perform the above operations, you agree to the terms and conditions of providing those services) or your consent, if we are talking about making commercial communications to you, without talking about similar products and services that you have already purchased from us, where we are entitled to send you commercial communications (but we will continue, permanently, to offer you the possibility to unsubscribe from that type of communications).

We may also sometimes need to request additional tax information, if we are required by law to file tax returns in relation to the products and services you have ordered. In that case, we will refer to your address (required to be included on the tax invoice), but also other tax data that the law requires us to collect and process in relation to the transaction in question. In this situation, the legal basis for the processing will be the obligation to comply with the provisions of the legislation.

We do not use your data to send marketing communications unless you explicitly opt in to such communication. Even in such cases, we ensure that you have an easy-to-use option to unsubscribe (withdraw consent) at any time, either in the communication itself or by contacting us by email or phone.

Dianemarie.ro also offers the possibility to send us a message. The data you send after using this contact option is processed based on our legitimate interest to respond to your request and / or to keep a record of your complaint, consultancy request and similar. This data is stored for 5 years.

  1. Data collected directly
    1. Creating a customer account

To create a customer account the following data is required. name, surname, e-mail, telephone number, address. A new account can be created either in the process of requesting the opening of a new customer account by you, or as a result of placing an order for the first time, in which case, in order to be able to honor your order, we will automatically activate a customer account for you.

Alternatively, there is the option of connecting with a Facebook account. After logging in, Facebook sends us: the numerical ID for the social network, your first and last name;

    1. Shopping in the Online Store

You can make purchases when you have a customer account, place products in the shopping cart and then complete an order. Alternatively, even if you do not have an activated account, you can create one when placing a new order. An order can also be picked up following a message on social media platforms/email or phone call.

The data collected after placing an order are: first and last name; delivery address; phone number.

Upon confirmation of the order, or when we announce that the products have arrived at the pickup points, we will process: your phone number and/or email address to inform you about the status of your order/delivery.

In order to fulfill your orders, deliver the products to the indicated address/hand over the products to the pickup points, execute our warranty obligations associated with the products, or, as the case may be, return the products.

    1. Payment by card/refund in case of product return/order cancellation.

The details of the card you use for 3D Secure payment of purchases in the Online Store cannot be accessed by Diane Marie, but only by the online payment processor. In the step of actually entering the details of the card you use for online payment, the identity of the online payment operator is also specified.

[3D Secure is a security measure that involves redirecting the customer when making a payment to a secure page where the registration of each cardholder is done by assigning an authorization code for each online transaction. Cards accepted for payment are those issued under the VISA (Classic and Electron) and MASTERCARD (including Maestro, if they have a CVV/CV2 code)].

The data collected/processed following online payment data sent to the operator for processing/authorizing online payments/transactions are: name, surname; order ID; transaction initiation date, completion date; transaction ID; payment status (payment made/not made); transacted amount (as applicable).

In the case of returns/cancellations of orders that cannot be processed in the payment operator's platform, we collect and process the IBAN and the bank where you opened the bank account to refund the money paid for the returned products/cancelled orders.

We provide the necessary support for processing by our authorized partners to mediate the payment of the products you order.

    1. Order delivery

To deliver the products to the indicated address, we communicate to the couriers strictly the necessary data: name, surname; delivery address; telephone number; amount payable by cash on delivery (as applicable).

When picking up the products from our collection points, in order to identify you, we will request the name left in the order and the unique shipment identification code.

We fulfill our obligations related to the management and delivery of products to the customer under the agreed conditions and times.

    1. Customer service and support

In order to provide you with support regarding your customer account/orders placed, we will identify you by confirming: your first and last name; your email address and phone number; your order ID.

It may process, with your prior consent, your voice from recordings of telephone conversations with you to respond to your requests for assistance or to resolve any complaints or notifications.

    4. The right to rectification of data - art. 16 GDPR. Allows you to obtain from us, without undue delay, the rectification or completion of inaccurate personal data concerning you.
    5. Right to data restriction - art. 18 GDPR. This is a temporary right. In some situations, between the moment when, for example, we take the decision to delete certain data (we no longer need the personal data for the purpose of processing) and the actual deletion of the data, you send us a request opposing the deletion, motivating the fact that you need these data for the establishment, exercise or defense of a right in court. As a result of such a request, we will "freeze" the data by stopping their processing for a certain period of time.
    6. Right to data portability - art. 20 GDPR. You have the right to receive the personal data concerning you that you have provided to the controller (who processes them on the basis of a contract or on the basis of your consent, by automated means) in a structured, commonly used and machine-readable format and you have the right to transmit these data to another controller, without hindrance from us. In other words, your personal data will be provided to you in a structured format so that you can decide whether to download them or, on the contrary, to send them to another controller.
    7. Right to object - art. 21 GDPR. You have the right to object, for example, to the processing of your personal data, when they are processed for direct marketing purposes. To make it clearer how you can exercise this right, it should be mentioned, for example, that in all newsletters coming from Dianemarie.ro (regardless of whether we are talking about newsletters that only provide information or newsletters that promote pantofidianemarie.ro services or products) you will always have the possibility to unsubscribe.
